Terms and Conditions

Welcome to Swamy Tours and Travels. By booking or using our services, you agree to be bound by the terms and conditions outlined below. These Terms and Conditions govern the usage of all services provided by Swamy Tours and Travels including but not limited to car rentals, outstation trips, tour packages, airport transfers, railway pick and drop, corporate travel, and all-India travel arrangements.

Please read these Terms carefully before proceeding with any booking. If you do not agree with any part of these Terms, you should refrain from using our services. By continuing to use, book, or access our services, you acknowledge that you have read, understood, and accepted all the conditions stated herein.

All vehicles shown on our website, brochures, advertisements, or social media pages are for illustration purposes only. The actual vehicle provided during service may vary in color, model, variant, or registration number depending on availability, operational conditions, or maintenance schedules.

While we strive to provide the same or equivalent model as booked, Swamy Tours and Travels reserves the right to substitute any vehicle with another of similar or higher category if the booked vehicle becomes unavailable due to unforeseen circumstances such as breakdown, maintenance, or prior delays.

3. Vehicle Substitution and Availability

Vehicle allocation is based on booking type, route, duration, and fleet availability. The company reserves the right to replace a booked vehicle with a similar or upgraded category vehicle without prior notice to ensure uninterrupted service.

The client acknowledges that vehicle make, brand, or model cannot be guaranteed and that changes may occur at the last moment due to operational reasons such as maintenance, driver unavailability, or technical issues.

5. Extra Kilometers and Waiting Time

The total fare is based on the agreed kilometer limit at the time of booking. If the actual travel exceeds this limit, extra kilometer charges will automatically apply as per the company’s rate chart for the specific vehicle type. Similarly, waiting charges apply when the vehicle is detained beyond the scheduled hours, whether by delay in pickup, personal stops, or extended use.

These extra charges must be paid in cash or digitally at the end of the trip, prior to vehicle release.

6. Client Responsibility and Vehicle Care

The client is responsible for maintaining reasonable behavior and care during travel. Any damage, spillage, stains, or loss to vehicle interiors, upholstery, or accessories caused by the client, their group, or luggage shall be charged to the client in full.

In the event of excessive damage, the client will be liable to compensate for repairs, cleaning, or replacement costs as estimated by the company. Smoking, consumption of alcohol, or use of illegal substances inside company vehicles is strictly prohibited.

8. Delays, Route Changes, and Unforeseen Circumstances

The company shall not be held responsible for delays caused by traffic congestion, weather conditions, road work, breakdowns, or any circumstances beyond its control. The driver may, at his discretion, choose an alternate route if necessary for the safety and convenience of the passengers.

In cases of force majeure , including strikes, natural calamities, political disturbances, or accidents, the company reserves the right to reschedule, modify, or cancel bookings without liability.

9. Driver Conduct and Client Behavior

All our drivers are trained professionals expected to maintain polite and courteous conduct. Likewise, clients are expected to treat the driver with respect. Any abuse, harassment, or misconduct towards the driver will result in immediate termination of service without refund.

10. Luggage and Belongings

The company assumes no responsibility for any loss, theft, or damage of personal belongings left in the vehicle. Clients are requested to check their luggage before disembarking. Oversized or heavy items must be declared during booking for appropriate vehicle allocation.

11. Insurance and Liability

All vehicles are covered under valid commercial insurance policies as per Indian Motor Vehicle laws. However, this coverage does not extend to passengers’ personal belongings or unauthorized usage of the vehicle. The company’s liability is limited strictly to the transportation charges paid by the client.

12. Corporate Bookings and Long-Term Contracts

For company tie-ups or long-term rental arrangements, separate contracts may be drawn outlining payment terms, vehicle allotment, and liability clauses. The company reserves the right to modify or terminate agreements upon breach of terms or delayed payments.

13. Driver’s Duty and Working Hours

Drivers are instructed to drive safely and adhere to rest intervals as per transport laws. Clients are requested not to pressurize drivers into overspeeding, continuous driving without breaks, or unsafe practices. The company will not be responsible for delays if caused by mandatory rest or unforeseen traffic issues.

14. Use of Vehicles

Vehicles provided are for the use specified during booking only. Sub-letting, unauthorized re-routes, illegal usage, or transport of prohibited materials are strictly forbidden. Violations will lead to immediate termination of service without refund and may invite legal action.

15. Promotional Content and Media Use

The company may use photos, testimonials, or feedback from clients for promotional purposes unless the client specifically requests in writing to opt out. Any photos of vehicles shown online are for representation only and may not match the actual vehicle assigned.

16. Force Majeure Clause

Swamy Tours and Travels shall not be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, strikes, lockdowns, or mechanical breakdowns. In such cases, efforts will be made to reschedule services without additional cost where possible.

17. Governing Law and Jurisdiction

These terms shall be governed and construed under the laws of India. Any disputes arising from these Terms shall be subject exclusively to the jurisdiction of the courts located in Mangalore, Karnataka.

18. Privacy and Communication

Client details such as name, phone number, and travel data are collected solely for service and communication purposes. We do not sell or share personal data with third parties, except when required by law or government authorities.

19. Amendments to Terms

Swamy Tours and Travels reserves the right to modify, update, or amend these Terms and Conditions at any time without prior notice. Updated versions will be posted on our official website and will take effect immediately upon publication.

20. Acceptance

By confirming a booking, making payment, or using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full. You also agree that any disputes will be resolved as per the laws mentioned above.
